The Contest called "#MyCalloftheBlue" is a limited period contest valid from 15th Aug 2022 – 15th Sep 2022, brought to you by India Yamaha Motor Pvt. Ltd and it is open to Resident Citizens of India except those residing in Tamil Nadu. The contest is not open for participants from the State of Tamil Nadu in view of the provisions of the Tamil Nadu Prize Scheme (Prohibition) Act, 1979.
Employees of India Yamaha Motor Pvt. Ltd its affiliates, representatives and their immediate family members are not eligible to participate in the Contest. Citizens of foreign countries residing in India and/or Non Resident Indians are not eligible to participate in the Contest.
The Participant agrees and accepts that he/she does not fall into the category of "influencer" as defined by Instagram and Facebook and that he/she also does not fall into the category of all types of influencers as defined by the above criteria, which are Nano Influencer, Micro Influencer, and Macro Influencer.
The main requirement for the Participant to enter this contest is that he or she have a public Instagram account and a public Facebook account that is not restricted or locked to the public.
The participant must read and abide by all the terms and conditions before taking part in the contest. The participation in the Contest shall imply that participant has read through and agreed to adhere to the terms and conditions and be bound by them.
Material pertaining to “#MyCalloftheBlue” is the property of India Yamaha Motor Pvt. Ltd.
No entry fee is charged to participate in the Contest.
You hereby represent and warrant that You (i) confirm that entering into this Contest and contesting the same do not violate or conflict with any laws, its constitutional documents, any other agreement it is or may be bound; (ii) shall at all times comply with all applicable laws and abide by all Yamaha’s policies and regulations, including (a) Anti-Corruption and Bribery; (b) Yamaha’s Privacy Policy; and (iii) confirm that the information provided by You (i) are accurate and complete; (ii) are not deceptive or misleading or infringes third party’s right; (iii) and are compliant with all Laws.
Winners will be decided by India Yamaha Motor Pvt. Ltd. The Photos & Videos with the highest number of likes or views will be declared as winners. A total of 4 winners (3 Video entries & 1 Image entry) will be selected from Facebook or Instagram. These four winners, will receive a fully paid trip to Malaysia for a period of three days to attend the MotoGP race at Sepang Malaysia on 23rd Oct 2022. The MotoGP passes will be of the basic category. For abundant clarity, the Participant agrees that Yamaha shall handle the visa application process. However, Yamaha shall not liable if the winner’s Visa is rejected. If anyone's visa is denied, the next best winner entry will be chosen to as winner and be eligible for this trip. Further, Yamaha will arrange ground transportation from the hotel to the Sepang track and back. However, any other local sightseeing or other personal expenses other than those under this Terms and Conditions like shopping etc must be paid for by the winners.
In addition to the above, 10 Winners to be announced fortnightly. 20 T Shirts & 20 Jackets will be awarded by end of the contest.
The Contestant agrees and acknowledges that no purchase or payment shall be made for increasing the number of likes or views, and that if such non-compliance comes to Yamaha's attention, such entries, as determined by Yamaha in its sole and absolute discretion, will be considered ineligible and will not be included in the Contest. Each Participant agrees that his or her entry complies with these terms and conditions by submitting an entry. Each Participant also agrees that Yamaha may disqualify them from the Contest if Yamaha believes, in its sole and absolute discretion, that an entry violates these terms and conditions.
By participating in this Contest, Participant agree to release and hold harmless Yamaha, each of their respective parent companies, affiliates, subsidiaries, officers, directors, representatives, agents and employees, from any and all liability whatsoever for any injuries, losses or damages of any kind arising from or in connection with, either directly or indirectly, 1) the awarding, acceptance, receipt, possession, use and/or misuse of any prize awarded herein; or 2) participation in the contest or any prize related activities, including but not limited to traveling to or from any prize related activity.
Participant and the person adjudged as winner shall be in compliance with all applicable laws and regulations of India and Malaysia, including, without limitation, laws and regulations relating to corruption and bribery. Any failure to comply with or breach of the applicable laws and regulations by the winner in Malaysia will not hold Yamaha responsible or liable in any manner whatsoever. It is the sole responsibility of the winner to face the consequences, and Yamaha is under no obligation to support in any way. Yamaha reserves the right to take any further action in such a circumstance, including suing the winner for damages.
India Yamaha Motor Pvt. Ltd holds all the rights to select or disqualify winners in case of discrepancy.
Every person registering on the “#MyCalloftheBlue” Website of India Yamaha Motor Pvt. Ltd shall be eligible to play the online Contest. Every participant shall be allowed one entry to play the online contest per month.
Winners will get a chance to win Yamaha T-shirt and Yamaha Jacket.
Prizes not claimed / documentation formalities not adhered to within 30 days of announcement of winners, will be forfeited by India Yamaha Motor Pvt. Ltd in its sole and absolute discretion.
The winning participants shall be informed of the result on Yamaha Facebook/Instagram page & on the Yamaha official website only.
The decision of the Yamaha Jury members will be final and binding. All winners will be required to submit proof of identity (passport, driving license, Voters ID, PAN Card, or school or college ID card). The winner/s shall be announced on Yamaha Motor India Facebook & Instagram page.
All information provided to You by Yamaha is deemed confidential and shall not be disclosed to anyone else, except as required under applicable law with prior written notice to Yamaha before disclosure of such information.
All taxes and other levies or charges applicable to the prizes shall be borne by the participants/winners and the same shall be deducted at the time of giving the prize.
Decision of India Yamaha Motor Pvt. Ltd in all matters relating to this Contest, including draws and prizes, shall be final and binding on the participants.
The Courts at Chennai shall have exclusive jurisdiction in case of any dispute.
India Yamaha Motor Pvt. Ltd reserves the right to vary, amend, and alter any terms of the Contest including the right to withdraw the Contest, at any time, without any notice.
All participants entering the Contest on the Yamaha Facebook & Instagram shall be deemed to have unconditionally agreed to the terms of the Contest and all decisions of India Yamaha Motor Pvt. Ltd in connection with this Contest.
Intellectual property rights involved as part of Contest shall vest in Yamaha. Also, Yamaha will retain ownership of the background used for images, typography, design content, visual effects, graphics and in all other property that was not created as part of provision of Contest.
By accepting a prize, Participant consents to the use of their name, photograph and/or likeness, voice, and statements made by or attributed to them, in perpetuity, in any and all media now known or hereafter developed (including, without limitation, print, broadcast, and Internet), for all legitimate business purposes of India Yamaha Motor Pvt. Ltd including advertising and promotional activities without additional compensation, unless prohibited by law.
In the event the prizes are delivered in a broken or damaged condition, the same shall be reported at the time of the receipt of the same itself. No subsequent claims shall be entertained.
